1. Scope and Purpose of the Terms and Conditions

The Service provided under these general terms and conditions consists of making available, via the address www.biofeet.pt, access to the Online Store which, in addition to providing information on the products and/or services, allows the User, by electronic means, to order the products advertised therein, under the terms and conditions described herein.

The website www.biofeet.pt is intended for the promotion and sale of products of the BIOFEET® brand, as well as products of brands associated with it.

The brands and product names used on the website www.biofeet.pt are its property, or registered trademarks of the respective companies or businesses.

These Terms and Conditions apply to users of the website www.biofeet.pt and to any operations and transactions, of a commercial nature or otherwise, carried out on the said website.

They were established in order to protect the brand and its users.

Browsing the website and the social networks associated with the BIOFEET® brand implies the customer’s acceptance of these Terms and Conditions.

The BIOFEET® brand reserves the right to amend these Terms and Conditions without prior notice.

Products may only be ordered by Users aged 18 (eighteen) years or over. Users under that age must have authorisation from their legal representatives.

The elements and information transmitted by the User on this platform shall have full legal effect, and the User acknowledges their rights and responsibilities, and may not invoke the lack of a signature to justify non-compliance with the obligations assumed.

2. Intellectual Property

The Store is a registered website and the service provided by the website itself is the responsibility of BIOFEET®.

The User acknowledges that the Service contains confidential information and is protected by copyright and related rights, industrial property rights, and other applicable legislation.

The User acknowledges that any content included in advertising, highlights, promotions, or mentions of any sponsor or advertiser is protected by copyright and related rights laws, industrial property laws, and other property protection laws, and that any use of such content may only occur under the express authorisation of the respective rights holders.

The User undertakes to fully respect the rights referred to in the previous paragraph, in particular by refraining from any acts that may violate the law or the said rights, such as reproduction, commercialisation, transmission, or making such content available to the public, or any other unauthorised acts relating to the same content.

3. Consumer Obligations

The user undertakes to:

i) Provide correct personal data and addresses;

ii) Not use false identities;

iii) Comply with the order limits imposed.

If any data is incorrect or insufficient, and for that reason there is a delay or impossibility in processing the order, or possible non-delivery, the responsibility lies with the User, and BIOFEET® declines any liability.

If the consumer breaches any of these obligations, BIOFEET® reserves the right to cancel future purchases, block access to the store, cancel the provision of any other services made available simultaneously by BIOFEET® to the same User; and also to prevent the User’s future access to any or all services made available by BIOFEET®.

The use of purchased products and services for commercial purposes, namely for the resale of goods, is expressly prohibited.

4. Product Information and Content

BIOFEET® will make every effort to ensure that the information presented contains no typographical errors. Any such errors will be promptly corrected whenever detected. If you purchase a product with characteristics different from those presented online, you have the right to terminate the purchase contract under the applicable legal terms (right of withdrawal).

BIOFEET® will make every effort to send all ordered products, but it is possible that, in certain cases and due to causes that are difficult for BIOFEET® to control, such as human error or incidents in IT systems, it may not be possible to supply one of the products requested by the User. If any product is not available after you have placed the order, you will be notified by email. At that time, and if you have already made the respective payment, you will be offered the option to cancel the order with the corresponding refund.

All information on prices, products, specifications, promotional campaigns, and services may be changed at any time by BIOFEET®.

5. Pricing Policy and Product Characteristics

The characteristics, prices, and specifications on this website are provided for information purposes only, and the website www.biofeet.pt reserves the right to modify, at any time, the information, commercial conditions, and commercial offers presented regarding products, prices, and/or promotional campaigns.

If, for any reason, the photos presented or the product characteristics are not considered sufficiently clear, you should contact BIOFEET® for clarification and to resolve any doubts.

If the information presented does not correspond to the product’s characteristics, the Customer has the right to terminate the purchase and sale contract under the applicable legal terms.

Product prices and specifications are subject to change without prior notice.

The information available on the website www.biofeet.pt is completely free of charge for its Users. Access to it does not create any type of commercial or professional relationship between users and the brand.

6. Complaints

If you consider there to be a defect in the product, you should send photographs to the email address info@biofeet.pt so that we can analyse the product.

Additional Information:

If, as a consumer, you consider that your rights have been violated, you may submit a complaint to the email address info@biofeet.pt, in order to seek an out-of-court resolution.

In the event of a dispute, the consumer may resort to a Consumer Alternative Dispute Resolution Entity.

7. Security Conditions

All products and services sold on the website www.biofeet.pt comply with Portuguese law.

The User undertakes to comply with all applicable legal provisions, namely not to carry out or encourage unlawful acts or acts contrary to good morals, such as the indiscriminate sending of unsolicited communications (spamming) in breach of the legislation applicable to the processing of personal data and advertising communications via automatic calling devices, and must also comply with the rules for using the Service, failing which BIOFEET® may suspend or deactivate the Service under the terms set out in point 4.

The User expressly acknowledges and accepts that the IP Network is a public electronic communications network that may be used by several users and, as such, is subject to IT overloads; therefore, BIOFEET® does not guarantee the provision of the Service without interruptions, loss of information, or delays.

BIOFEET® likewise does not guarantee the provision of the Service in situations of unforeseeable overload of the systems on which it relies, or force majeure (situations of an extraordinary or unforeseeable nature, external to BIOFEET® and beyond its control).

In the event of interruption of the provision of the Service due to unforeseeable overload of the systems on which it relies, BIOFEET® undertakes to restore its operation as quickly as possible.

The data and information entered by the User within the scope of this Service are presumed to be true, and BIOFEET® declines any liability arising from abusive or fraudulent use of the information provided.

8. Updates

Whenever BIOFEET® deems it necessary or convenient to optimise the browsing experience and/or improve connectivity conditions, it may remotely reconfigure network settings.

Without prejudice to the provisions of the following paragraphs, and given the innovative nature of the Service and the technological developments to which it may be subject, BIOFEET® may change its technical configurations whenever this proves convenient in order to adapt it to any technological developments.

9. IT Security

The BIOFEET® brand is not responsible for any abusive acts or improper use of its name, nor for links to the domain www.biofeet.pt on other pages.

BIOFEET® shall not be liable for any losses or damages caused by abusive uses of the Service that are not directly attributable to it by intent or gross negligence.

The website www.biofeet.pt is equipped with security systems that ensure the protection of data entered by Users. Prevention of unauthorised access to data, improper use, disclosure, loss, and/or destruction is also ensured.

It is entirely the user’s responsibility to ensure that their computer is protected against malicious software and computer viruses.

10. Suspension and Deactivation of the Store Service

Regardless of any prior or subsequent communication, BIOFEET® may, at any time and at its sole discretion, discontinue the provision of the Service and/or part of the Service to one or all Users.

BIOFEET® also reserves the right to suspend or immediately terminate access to the Service in the following cases:

a) When the User does not comply with the conditions of use referred to in point 3 (Consumer Obligations) and others referred to in the General Conditions;

b) When BIOFEET® terminates access to the Store, by prior notice given 15 days before the termination date.

The suspension or termination of the Service by BIOFEET®, under the terms of the previous paragraphs, does not give the User, or third parties, the right to any indemnity or other compensation, and BIOFEET® may not be held liable or otherwise burdened for any consequence resulting from the suspension, annulment, or cancellation of the Service.

In the situations described above, BIOFEET® will notify the User in advance so that they may, if they so wish, safeguard the content of their order viewing area within 3 (three) business days from the sending of the email or the availability of the information on the Service’s main page.

11. Data Transmission

Any content or communication of non-personal data sent to this web page and/or its associated social networks, by email or any other means, containing information, questions, comments and/or suggestions, will be treated as non-confidential data free of proprietary rights.

The data indicated above, sent to us by email or posted on our website or social networks associated with the brand, becomes the property of BIOFEET® and may be used in any circumstances, including, among others, disclosure, reproduction, publication, and dissemination of content on the web.
